Driving School

 

Persons who are charged with the offense of speeding, may avoid the possibility of conviction by attending an approved driving school if, they meet the following requirements:
a)
 
they do not currently hold a commercial drivers license (CDL);
 
b)

 
they are not charged with having exceeded the posted speed limit by more than 12 miles per hour;
 
c)

 
they have not attended an approved driving school within three (3) years of the commission of the pending charge;
 
d)

 
they attend and complete a driving school that has been approved by the General Sessions Court in the county of their residence;
 
e)

 
they have no more than one prior conviction for speeding/reckless driving within five (5) years preceding  the commission of the pending charge; and
 
f)
 
they pay the court cost within fourteen (14) days of completing the driving school.

 

Persons who meet the requirements listed above, may avoid personally appearing in court on their scheduled court date by submitting an application for eligibility to the Dunlap Municipal Court Clerk at least ten (10) days prior to their scheduled court date. Providing false information on this affidavit could lead to additional charges. Upon receipt of an application,  the Court Clerk shall forward the application to the charging officer who shall check the applicant's driving record to confirm the applicant meets the requirements listed above. If the applicant meets these requirements, then the Clerk shall submit the application with a copy of the applicant's driving record to the Municipal Judge who will approve an Order granting the request if the requirements are satisfied. In the event that the officer takes issue with whether the applicant meets the requirements above, the Clerk shall notify the applicant and require him/her to personally appear on the scheduled court date and the Court will then determine if the applicant meets the requirements.
